"Sylvester Stallone has delivered a knockout punch to an author who claimed to be the real writer behind The Expendables.

Marcus Webb sued Stallone last October and claimed that the 2010 film was "strikingly similar" to his own copyrighted work, from the opening sequence to the plot to the character of the villain.

But a judge has ruled his claims to be expandable, tossing the lawsuit on summary judgment on Monday.

Webb's own script was called The Cordoba Caper about "a team of elite, highly-trained mercenaries" and the author said that Stallone and co-writer David Callaham may have had access since it was shopped around Hollywood for several years late last decade."

The idea of a team of elite, highly-trained mercenaries is an incredibly common one.

Sounds like a last desperate attempt to make some money at being a script writer. The two stories, other than being about mercenaries taking on a South American General/Dictator are nothing alike.

Right, Scott. It's kind of like saying, I have a story about a good guy and a bad guy.

Now, for someone as serious about movies as I am, I have a soft spot for Stallone. That said, I was disappointed with The Expendables. It's plot was as basic as I'd ever seen. There was practically no character development, too many characters, and the dialogue, and concepts, it just didn't come out well. The best part of the movie was seeing how ripped Stallone has kept himself.
